1. The service and acceptance
The virtual try-on uses artificial intelligence to create a preview of how one or more of a store’s products (for example, footwear, trousers, shorts, shirts, dresses or face accessories such as glasses) look on you, from a photo of you. The service is provided by 58.025.078 Vinicius dos Santos Felix, CNPJ 58.025.078/0001-40, Jacareí, São Paulo, Brazil (“Experimenta”), and is free for shoppers.
By using the try-on, you confirm that:
- you are 18 years of age or older;
- you have read and accept these Terms and the Privacy Policy;
- the photo is of you, or you have permission from the person in it, who is also 18 or older.
If you do not agree, do not use the try-on. You can still buy from the store as usual.
2. The preview is illustrative; you buy from the store
The generated image is an approximate simulation. The artificial intelligence may fill in parts of the body that are not in the photo, such as the legs. It may contain errors and may differ from the real product in color, proportion, detail, size and fit, and it does not replace the store’s size chart.
Experimenta does not sell products. Price, stock, payment, delivery, exchanges and returns are the store’s responsibility under the Brazilian Consumer Protection Code. Questions about your purchase should be handled directly with the store.
3. Permitted and prohibited use
Use the try-on only to try the store’s products on yourself. You must not:
- upload a photo of another person without their permission, or of anyone under 18;
- upload nudity or sexual, violent, offensive, discriminatory or illegal content;
- use the result to deceive, defame or impersonate anyone;
- try to bypass usage limits, automate uploads, copy or reverse-engineer the service, or interfere with how it works.
The system may reject a photo automatically, for example when there is more than one person, when the part of the body where the product will appear is not in the photo (for example, the feet, for footwear) or when the content is inappropriate. In case of abuse, we may block the try-on on that device.
4. Your photo, the result and trademarks
- Your photo remains yours. You allow us to use it only to create the preview (sending a crop of it to an artificial intelligence provider, in the United States, and storing it on our servers, in France), for the period described in the Privacy Policy. We do not use your photo for advertising, AI training or any other purpose.
- The result is for personal use. You may download it and share it, for example with friends. Commercial use of the result is not allowed.
- Trademarks and products shown belong to their owners and to the store. Experimenta, its brand and its software belong to Experimenta.
5. This website and the waitlist
The experimenta.store website presents Experimenta to merchants. Joining the waitlist does not create a contract or guarantee access to the beta; we will get in touch as places become available. Merchants’ use of the dashboard is governed by a separate agreement. Details sent through the form are handled as described in the Privacy Policy.
6. General provisions
Availability and limits. The try-on may be temporarily unavailable, may have usage limits per person or per store, and may be changed or discontinued by the store or by Experimenta. Attempts that fail because of a problem on our side do not count toward your limit.
Liability. We work to keep the service running well and securely, but the preview is a simulation and does not guarantee the outcome of your purchase. Nothing in these terms limits the rights you have under the Brazilian Consumer Protection Code and the LGPD.
Privacy. How we handle your photo and other data is described in the Privacy Policy, which forms part of these terms.
Problems and contact. Use the “Relatar problema” (Report a problem) button in the try-on or write to contato@experimenta.store. For privacy and data deletion: privacidade@experimenta.store.
Changes. We may update these terms. The version and date are shown at the top of the page, and significant changes will be announced in the try-on before your next use.
Governing law and venue. These terms are governed by Brazilian law. Any dispute relating to them will be resolved in the courts of the shopper’s place of residence.
